The Ondo State Local Government Election Petition Tribunal has commenced sitting in Akure on a petition filed by the Councillorship Candidate of the African Democratic Congress (ADC), Ojo Busola Emmanuel and his party against the outcome of the rerun Councillorship Election of Igbara-Oke ward -1 in Ifedore local government area.

The Ondo State Independent Electoral Commission, ODIEC, had on 10th November, 2021 allegedly held the rerun election in Igbara-Oke and declared Lawal Kehinde of the All Progressives Congress (APC) as the winner.

During its inaugural sitting in Akure on Wednesday, the 3-man Tribunal headed by Justice DJ Kolawole, which has Chief Magistrate Fatai Ajiboye and Magistrate C. Adeyanju as members, gave AN ORDER for substituted service of the ADC Candidate’s Petition and other subsequent processes of the Tribunal on the APC and its Candidate, Lawal by pasting same on the wall of the APC state Secretariat on Oyemekun Road, Akure.

Ojo Busola Emmanuel and the African Democratic Congress (ADC) are first and second Respondents respectively.

Lawal Kehinde is the first respondent, All Progressives Congress (APC) is the second Respondent while the Ondo State Independent Electoral Commission (ODIEC) is the third Respondent in the suit.

The tribunal ruled after Counsel to the ADC candidate, Barr Femi Emmanuel Emodamori moved the Motion Ex-parte and the affidavit of Ojo Busola Emmanuel.

“TO THE INHERENT JURISDICTION OF THE HONOURABLE TRIBUNAL; AN ORDER for substituted service of the Petitioners/Applicants‘ Petition and other subsequent processes of this Honourable Tribunal on the 1st and 2nd Respondents by pasting same on the wall of the 2nd Respondent’s Secretariat at No 90, Oyemekun Road, Akure.

“UPON MOVING the Motion Ex-parte and the affidavit of Ojo Busola Emmanuel, Male, Christian, Nigeria Citizen of No 34, Oketa Street, Igbara-Oke, Ondo State, sworn to and filed at the Local Government Election Petition Tribunal Registry, Akure on 8th day of December, 2021.

“COMING UP for hearing before the Chairman, Hon. Justice DJ. Kolawole, Mr Fatai Ajiboye (Member 1) and Mrs C. Adeyanju (Member 2) on the 8th day of December, 2021 in the presence of the Petitioners/Applicants‘ and their Counsel.

Positive fm gathered that the substituted service of the petition had been effected on Wednesday afternoon as directed by the court.
