Justice B.J. Akinwumi of the Ondo State High Court of Justice, Owo Judicial Division holding in Owo has refused the deposed Olute of Ute, Retired Major Adetunji Oluwole-Akinrogbe’s application for injunction on stay of execution of his sack.

 

Major Oluwole-Akinrogbe had approached the court seeking restraint  from giving effect to the judgment of May 21st, 2024 pending the hearing and determination of the appeal against the judgment of his removal as Olute of Ute.

 

Major Oluwole-Akinrogbe was also seeking order restraining Ondo State government from dealing with the claimants/Respondents, Princes Boboye, Oseni and Shehu Omoloja from selecting a new Olute of Ute pending the hearing and determination of appeal.

 

Justice Akinwumi maintained that the executory aspect of the judgment could be stayed pursuant either to an application for stay or injunction pending determination of appeal.

 

He, however said having considered the application and heard argument of counsel in the instant application noted that the applicant had not placed sufficient material facts before the court to persuade it exercise its discretion in his favour.

 

Justice Akinwumi therefore accordingly refused the application for injunction by Major Oluwole-Akinrogbe.
